Resolution in which the Port of Port Orford Defends the Bill of Rights and the Civil Liberties of its District Residents

The purpose of this resolution is to protect the civil rights and liberties of all people as stated in the United States and Oregon Constitutions and ORS 181.575 and ORS 181.850.

WHEREAS, all members of the Port Commission of the Port of Port Orford have sworn to defend the United States and Oregon Constitutions, and;

WHEREAS, the Port of Port Orford remains committed to the protection of the rights and liberties of the residents of the port district as guaranteed by the United States and Oregon Constitutions and ORS 181.575 and ORS 181.850, and;

WHEREAS, the Port of Port Orford has concerns that certain provisions of the U.S.A. P.A.T.R.I.O.T. Act, the Homeland Security Act, and other laws and executive orders passed since the terrorist attacks of Sept. 11th, 2001 may infringe upon the rights and liberties guaranteed to its residents by the Bill of Rights of the United States Constitution.

BE IT RESOLVED THAT the Port of Port Orford opposes any portion of the U.S.A.P.A.T.R.I.O.T. Act, Homeland Security Act, and executive and judicial orders that would violate the rights and liberties guaranteed equally by the state and federal constitutions.

BE IT FURTHER RESOLVED THAT the Port Manager, port employees and all port officials preserve freedoms of speech, religion, assembly, and privacy and all other rights contained in the Bill of Rights of the United States Constitution and the Oregon State Constitution and that no port funds or resources shall be expended for activities not supported by the United States Constitution, Oregon Constitution, or Oregon Revised Statutes which violate these freedoms.

BE IT FURTHER RESOLVED THAT the Port Manager shall regularly advise the Port Commission and the public of any attempts by federal agencies to require the port to violate any of the above freedoms.

BE IT FURTHER RESOLVED THAT the Port of Port Orford urges the United States Congress to correct provisions of the U.S.A.P.A.T.R.I.O.T. Act and other measures that infringe on civil liberties and opposes any pending future federal legislation that infringes on civil rights and liberties.

BE IT FURTHER RESOLVED THAT the Port Commission Chair will send copies of this resolution to the President of the United States, the U.S. Attorney General, to each member of the Oregon Congressional Delegation and to the Governor of Oregon.
